Conservative digital figure Ashley St. Clair has taken legal action against tech billionaire Elon Musk, filing paternity and custody petitions in Manhattan’s Supreme Court. St. Clair alleges that Musk is the father of her five-month-old son, conceived during a trip to St. Barths in January 2024. The legal proceedings, which began on February 21, 2025, have drawn significant public attention due to the high-profile status of both parties involved.

St. Clair is seeking sole custody of the child, identified as R.S.C., who was born in September 2024. The birth certificate currently lists no father, and the child bears St. Clair’s last name. As part of her legal action, St. Clair has requested the court to require Musk to undergo a genetic test to confirm paternity.

The court filing includes a photo of Musk holding an infant and alleged flirtatious text exchanges between St. Clair and Musk. These leaked messages show Musk expressing eagerness to see St. Clair and the child, as well as making suggestive remarks.
In one such exchange, Musk allegedly wrote, “I look forward to seeing you and him this weekend.”
St. Clair claims that Musk was absent during the child’s birth and has only met the child three times. She has expressed frustration over Musk’s lack of communication regarding the matter. According to St. Clair, she initially intended to keep the situation private to protect the child but felt compelled to go public due to potential leaks.
As of now, Musk has not publicly acknowledged the allegations, and his lawyer has not commented on the situation.
The most we’ve seen is Musk responding to tweets showing that St. Clair had been targeting him for years, responding with just one word: “Whoa!”
St. Clair’s attorneys have reportedly attempted to resolve the matter privately with Musk’s legal team but have faced non-responsiveness. This silence has prompted St. Clair to seek a court summons for Musk to show cause for not being declared the father and to order support.
This is not the first time Musk has been involved in custody-related legal matters. He previously settled a custody battle with musician Grimes over their three children in August 2024. The current situation with St. Clair adds another layer of complexity to Musk’s personal life, which has often been subject to public scrutiny.
